Terms and Conditions of Sale
Thank you for choosing Brian Pasko Photography! I am honored to help you capture these milestones. Because the images and products I provide are custom-created and often involve coordination with schools or leagues, the following terms apply to all online sales and transactions.
1. All Sales are Final. Due to the custom nature of professional photography, all sales are final. Once an order is placed, it is immediately placed into production. Refunds or exchanges are not offered for a change of mind, "buyer's remorse," or ordering errors after the purchase is complete.
2. Digital Downloads. Digital image sales are final. The "Point of No Return" occurs at the moment a digital link is accessed or a file is downloaded. Because a digital asset cannot be "un-delivered," no refunds will be issued for digital products for any reason. Download links remain active for six (6) weeks from the date of purchase. It is the Buyer’s responsibility to download and back up all images immediately. Brian Pasko Photography LLC may, at its discretion, apply an un-archival fee for requests to reactivate download links after the 6-week window has expired.
3. Order Accuracy. The Buyer is responsible for providing accurate shipping/billing information and reviewing image selections, quantities, and cropping before completing the purchase.
4. Copyright & Personal Use. Brian Pasko Photography LLC retains the legal copyright to all created images consistent with state and federal copyright laws. The Buyer is granted a non-exclusive license for personal use of purchased prints and digital images (e.g., personal printing and social media sharing). Use of these images for commercial purposes, resale, or entry into contests is prohibited without express written permission from Brian Pasko Photography LLC.
5. Quality Guarantee. Physical products arriving with a manufacturing defect or shipping damage will be replaced at no cost. Defects must be reported to info@brianpasko.com within seven (7) days of delivery to qualify for a replacement. While digital files may be printed elsewhere, Brian Pasko Photography LLC does not guarantee the color accuracy or quality of prints manufactured at third-party or consumer labs.
6. Batch Delivery Liability. For orders designated for delivery to a school, league, or institution, the responsibility for the condition of the products shifts to the organization and the student upon receipt by the organization. Brian Pasko Photography LLC is not liable for damage, loss, or degradation of products that occurs after the initial delivery to the institution or while in the possession of the student. Direct shipping to a home remains an available option for an additional fee for those wishing to avoid these concerns or who require faster or more direct delivery.
7. Data Privacy. Personal information (name, email, and address) is collected solely for the purpose of order fulfillment and gallery access. Brian Pasko Photography LLC does not sell or share customer data with third parties for marketing purposes.
8. Dispute Resolution. The Buyer agrees to contact Brian Pasko Photography LLC at (503) 704-2188 or info@brianpasko.com to resolve any concerns before initiating a chargeback or dispute with a credit card company or payment processor.
9. Limit of Liability and Governing Law. In the event of any dispute, the total liability of Brian Pasko Photography LLC shall not exceed the total amount paid by the customer for the order in question. These terms are governed by the laws of the State of Oregon.
